1. ACCEPTANCE OF TERMS
By accessing the LUMAN website or purchasing our hardware, you agree to be bound by these Terms of Service (“Terms”) and all applicable laws. If you do not agree with any part of these Terms, you are prohibited from using this site or acquiring LUMAN products.
2. USE OF TACTICAL HARDWARE
LUMAN products, including but not limited to the Shadow-IR™ system, Combat Pro footwear, and Tactical EDC systems, are professional-grade hardware.
- User Responsibility: You represent and warrant that your use of the gear complies with all local, state, and federal regulations.
- Prohibited Use: You may not use our products for any illegal or unauthorized purpose.
- Operational Nature: You acknowledge that tactical gear requires proper training and common sense. LUMAN is not responsible for injuries resulting from misuse or “tactical cosplay” scenarios.
3. ACCURACY AND MODIFICATIONS
We strive for “zero-fail” accuracy in our product descriptions. However, we do not warrant that product descriptions, imagery, or pricing are 100% error-free.
- We reserve the right to modify or discontinue any “hardware” (product) without notice.
- Prices for our products are subject to change without notice.
4. INTELLECTUAL PROPERTY
The “LUMAN” name, logo, and proprietary technologies (such as Shadow-IR™ and QuickLatch™) are the exclusive intellectual property of LUMAN Tactical Systems. Any unauthorized reproduction, “cloning,” or distribution of our designs is a breach of these Terms and will be met with legal action.
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMAN TACTICAL SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE OUR PRODUCTS.
Note: Our gear is built to support your mission, but no equipment is a substitute for professional training and situational awareness. In no event shall LUMAN’s total liability exceed the amount paid by you for the specific product in question.
6. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless LUMAN Tactical Systems and our affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
7. GOVERNING LAW
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the jurisdiction in which LUMAN is headquartered, without regard to conflict of law principles.
8. SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.
